The request is the culmination of multiple unsuccessful attempts to convince Southwest Judicial District Judge James Gion that Morton County is the wrong venue for the lawsuit.

In a separate lawsuit over the pipeline, the state of North Dakota seeks $38 million from the U.S. Army Corps of Engineers. The Army Crops has jurisdiction over the portion of the pipeline that passes underneath Lake Oahe, and owns the land that became site of the largest protest camp during the demonstrations.

Dallas-based Energy Transfer and its subsidiary Dakota Access allege trespass, nuisance, defamation and other offenses by Netherlands-based Greenpeace International and its American branch, Greenpeace USA. The lawsuit also names the group’s funding arm, Greenpeace Fund Inc.
